Terms of Use — KeepPushing

Article 1 — Purpose and acceptance

1.1. These Terms of Use ("Terms") govern access to and use of the KeepPushing web application (the "Service"), available at https://keeppushing-app.sitiam-solutions.com, and of its public site https://keeppushing.sitiam-solutions.com.

1.2. KeepPushing lets you organise karting leagues between friends: create or join a league, propose outings and polls, sign up, enter results, view standings, form teams and browse a directory of circuits.

1.3. Creating an account constitutes acceptance of these Terms. If you do not accept them, do not use the Service.

1.4. The following documents supplement these Terms and are available at any time from the application:

Article 2 — Publisher and contact

2.1. The Service is published by SITIAM Solutions, a French single-member limited liability company (EURL) with a share capital of EUR 1,000, registered office at 46 rue Bouffard, 33000 Bordeaux, France, registered with the Bordeaux Trade and Companies Register under no. 985 405 844 (SIREN 985 405 844 — SIRET 985 405 844 00020), EU VAT no. 2.2. The Service is hosted by OVH SAS (OVHcloud), 2 rue Kellermann, 59100 Roubaix, France, tel. +33 9 72 10 10 07.

Article 3 — Definitions

  • Account: the personal space created by a user, identified by an e-mail address.
  • League: a group of members organised around karting outings, managed by one or more administrators.
  • Administrator: the member who manages the league (members and roles, outings, seasons, results, export, deletion).
  • Member: any account attached to a league.
  • Content: anything users enter or upload in the Service (nicknames, league and team names, outings, polls, results, photos of result sheets, private circuits, etc.).
  • Plan: one of the three service levels described in Article 10 (Free, Ad-free, Plus).

Article 4 — Access conditions

4.1. The Service is intended for private individuals, for personal, non-commercial use.

4.2. You must be at least 15 years old to create an account; by creating one you declare that you are. If you are under 15, you may not use the Service. Subscribing to a paid plan is reserved for adults or minors acting with the consent of a holder of parental authority (see the Terms of Sale).

4.3. Access requires a device and an internet connection at your expense. The Service runs in a recent browser and can be installed as an app; it does not work offline.

4.4. The Service is provided in French; an English version of some screens may be offered for convenience.

Article 5 — Account

5.1. Creation. You create your account with an e-mail address and password, or with your Google account ("Continue with Google"). The information you provide must be accurate and kept up to date. An account is personal and may not be transferred or shared.

5.2. E-mail confirmation. An account created with a password must confirm its e-mail address via the link received. Until then you may log in and join a league by invitation, but you may neither create a league nor submit a result sheet. You may request a new link from the app.

5.3. Security. You are responsible for keeping your credentials confidential and for all activity carried out from your account. In case of unauthorised use, change your password and notify us without delay. Resetting your password, like logging out, closes all open sessions on all your devices.

5.4. Google. If you use "Continue with Google", Google confirms your e-mail address and sends us an identifier; we never have access to your Google password. Use of your Google account remains subject to Google's terms.

5.5. Deletion. You may delete your account at any time from your profile. Deletion is permanent. It immediately cancels any current paid subscription, with no refund of the remaining period (see the Terms of Sale). Your account, login identities, league memberships, votes, outing registrations and invitation links are removed. The leagues' sporting history remains: your driver becomes a mere name on the grid, and published results, standings, records and sheet photos stay with the league. If you are the only administrator of a league, you must first appoint another administrator or delete the league.

Article 6 — Leagues, roles and membership

6.1. Creation and administration. Any confirmed account may create a league and becomes its administrator. Administrators may appoint other administrators; a league always has at least one.

6.2. Invitation. You join a league through an invitation link shared by a member. Only share this link with people you want in the league. The administrator may regenerate the link, which invalidates the previous one.

6.3. Number of leagues. The number of leagues (created or joined) per account depends on your Plan: 2 on Free and Ad-free, 10 on Plus. Each league holds at most 24 participants.

6.4. Visibility. A league's Content is visible to all its members. A league you are not a member of is inaccessible to you.

6.5. Removal of a member. An administrator may remove a member from the league. The removed member loses access; their registrations for upcoming outings are cancelled; their past results remain in the league's history.

6.6. Export. The administrator may export the league's data (participants, outings, sessions, published results, standings) as spreadsheet-readable files, and undertakes to use it only in the league's interest and in compliance with members' rights.

6.7. Deleting a league. The administrator may permanently delete the league and all its data, for all members. This is irreversible and affects no subscription.

6.8. Administrator's responsibility. The administrator is answerable to members for the use of their powers (roles, removals, export, deletion). SITIAM Solutions does not intervene in the internal life of a league.

Article 7 — User content

7.1. You remain the owner of your Content. You grant SITIAM Solutions a free, non-exclusive, worldwide licence to host, reproduce, display and technically adapt your Content, solely to the extent necessary to operate the Service and for as long as the Content is in the Service.

7.2. You warrant that you hold the necessary rights to your Content, in particular photos of result sheets, and that you respect third-party rights (copyright, image rights, privacy). You do not publish data about a person without their consent where it is required.

7.3. A league's Content is shared among its members and may remain after you leave or delete your account, under Article 5.5 and the privacy policy.

7.4. SITIAM Solutions does not pre-screen Content and is not its author. We may remove manifestly unlawful Content or Content contrary to these Terms reported to contact@sitiam-solutions.com, after informing its author except in urgent cases.

Article 8 — Rules of conduct

You undertake not to:

  • use the Service for unlawful or commercial purposes or purposes foreign to its object;
  • publish abusive, defamatory, hateful, discriminatory or pornographic Content or Content infringing others' rights;
  • impersonate anyone or create accounts in bulk;
  • disrupt the Service (unauthorised access attempts, overload, automated extraction, circumvention of Plan limits);
  • use other members' details or data for purposes other than the life of the league.

Article 9 — Circuit directory

9.1. The circuit directory is built from OpenStreetMap data, © OpenStreetMap contributors, available under the Open Database License (ODbL): https://www.openstreetmap.org/copyright. The data is a dated snapshot and may be incomplete, inaccurate or outdated (opening hours, phone, address, closure).

9.2. Always check with the circuit before travelling. You may report an error to us or correct it directly on OpenStreetMap. SITIAM Solutions has no relationship with the listed circuits and does not guarantee their opening, services or prices.

9.3. Private circuits added by a league remain visible to that league only and are never published.

Article 10 — Plans and advertising

10.1. The Service comes in three Plans: Free (with advertising, 2 leagues), Ad-free and Plus (no advertising, 2 and 10 leagues respectively). Paid Plans are governed by the Terms of Sale.

10.2. Advertising. On the Free Plan, ads may be displayed on the league home and the outings list, only if you have consented through the consent message shown to you. You may change your choice at any time from your profile or the "About" page ("Cookies & advertising"). Without consent, no ad is displayed. Ads are served by Google; how they work is described in the privacy policy. The Service performs no audience measurement.

10.3. Ad-free and Plus subscribers see no advertising.

Article 11 — Intellectual property

11.1. The Service (software, structure, texts, graphics, KeepPushing brand and logo, SITIAM Solutions brand) is protected by intellectual property law and remains the property of SITIAM Solutions or its licensors. These Terms grant you only a personal, non-exclusive, non-transferable right to use the Service for the lifetime of your account.

11.2. Any reproduction, extraction, decompilation or exploitation of the Service outside its normal use is prohibited without written authorisation or a legal exception.

11.3. OpenStreetMap data remains subject to the ODbL (Article 9).

Article 13 — Availability and changes to the Service

13.1. SITIAM Solutions strives to keep the Service continuously available without guaranteeing uninterrupted availability. Interruptions for maintenance, updates or incidents may occur; we strive to limit and, where possible, announce them.

13.2. The Service evolves. We may add, change or remove features. A change that would significantly reduce a feature of a paid Plan is notified at least 30 days in advance and entitles you to terminate free of charge under the Terms of Sale.

13.3. You are encouraged to export your league's important data regularly (Article 6.6). The Service is not an archiving service.

Article 14 — Liability

14.1. SITIAM Solutions is liable for the proper performance of the Service as provided by law, including the statutory conformity guarantee for digital services (Articles L224-25-12 et seq. of the French Consumer Code), recalled in the Terms of Sale.

14.2. SITIAM Solutions is not liable for damage resulting from force majeure, use of the Service contrary to these Terms, failure of your equipment or connection, Content published by users, third-party information (OpenStreetMap, circuits) or decisions taken by league administrators.

14.3. You are responsible for your Content and your use of the Service, and for the consequences of karting itself, which is a matter between you and the circuits.

14.4. Nothing in these Terms limits your statutory rights as a consumer.

Article 15 — Suspension and end of the contract

15.1. By you. You may stop using the Service and delete your account at any time (Article 5.5).

15.2. By SITIAM Solutions. In case of breach of these Terms, we may suspend your access after informing you by e-mail and allowing a reasonable time to remedy where possible. For serious breaches (threat to the Service's security, manifestly unlawful content, fraud), suspension may be immediate. If the breach persists, we may close your account with 15 days' notice. A paid subscription terminated for serious breach is not refunded for the remaining period; otherwise the unused part of the period is refunded.

15.3. Discontinuation. Should SITIAM Solutions decide to discontinue the Service, you would be informed at least 60 days in advance with the opportunity to export your data; subscriptions would be refunded pro rata for the unused period.

Article 16 — Changes to the Terms

We may amend these Terms. The new version is notified by e-mail or in the app at least 30 days before it takes effect, except for minor changes or changes required by law, which apply immediately. If you refuse the new version, you may delete your account before it takes effect; a subscriber may terminate under the Terms of Sale. Continued use after that date constitutes acceptance.

Article 17 — Governing law, language and disputes

17.1. These Terms are governed by French law. They are written in French; this English version is provided for convenience only and the French text prevails in case of discrepancy.

17.2. In case of difficulty, first write to contact@sitiam-solutions.com; we undertake to reply within 30 days.

17.3. If the disagreement persists, you may use, free of charge, the consumer mediator: CM2C — Centre de la Médiation de la Consommation de Conciliateurs de Justice, 49 rue de Ponthieu, 75008 Paris, litiges@cm2c.net — https://www.cm2c.net/declarer-un-litige.php, within one year of your written complaint (Articles L611-1 et seq. of the French Consumer Code).

17.4. Failing agreement, the dispute falls under the competent French courts. You may bring the matter, at your choice, before one of the courts with territorial jurisdiction under the French Code of Civil Procedure or the court of the place where you lived when the contract was concluded or the harmful event occurred (Article R631-3 of the French Consumer Code).
